Planning Scheme amendments

Application may be made to amend the Clarence Planning Scheme 2007.  Draft planning scheme amendments are assessed under Part 3, Division 2 of the Land Use Planning and Approvals Act 1993

Following the submission of an application for a planning scheme amendment Council is required to determine whether or not to initiate and certify the draft amendment.  If affirmative the draft amendment will be advertised and exhibited for public consultation.  Any representations received are required to be considered by Council and a detailed report forwarded to the Tasmanian Planning Commission.  The Tasmanian Planning Commission may or may not hold a hearing on the draft amendment.  The Commission may:

  • approve the draft amendment; or
  • modify the draft amendment, or direct the council to do so;
  • direct the council to alter the draft amendment to a substantial degree; or
  • reject the draft amendment.

If the amendment is approved the Commission will set a date for it to commence.
